Recruit 360 Jobs terms for job seekers

These terms are an agreement between you and Idealweb (Pty) Ltd (“we”), the provider of Recruit 360 Jobs. Recruit 360 Jobs is the platform that hosts recruitment agencies' careers pages, job adverts, applications and registrations. The terms apply when you view an advert, apply or register through a page or form we host for an agency, including one shown inside the agency's own website, and when you use an account with us. They do not govern the rest of an agency's website, or the agency's own recruitment terms and privacy notice. They are also separate from the agreements under which agencies use our software. Recruit 360 Jobs is for people of 18 and over.
Accepting these terms
You accept these terms when you create a profile, register with an agency or send an application through Recruit 360 Jobs, and we keep a record of the version you accepted and when. If you use the service without doing so, for example to view adverts or to set up a job alert, these terms apply to that use.
Accepting these terms is not, in itself, consent to any particular use or sharing of your personal information, to marketing, or to taking part in any other service we operate. The privacy notice explains how your information is handled, and where we ask for your consent.
What we do, and what agencies do
We supply the technology: the pages, the forms and the systems that carry your application or registration to the agency. Agencies, and the employers they act for, decide whom to contact, shortlist, interview and employ, and on what terms. Automated tools may be used to read a CV and to screen, match or score applications against criteria an agency has set, and an application may be advanced or declined on that basis. The agency or employer remains responsible for the decision; ask the agency how an application is assessed. We do not promise you a reply, an interview, an offer or a job.
We do not charge job seekers for the features currently offered on Recruit 360 Jobs.
Adverts and agencies
Adverts are supplied by agencies, or prepared from information they or their clients supply, in some cases with automated assistance or by import from another system. Each agency is responsible for its adverts and for its dealings with you, and agencies are independent of us.
We may review, decline, suspend or remove an advert or other content. We do not verify every advert, agency or employer, and hosting or reviewing an advert is not an endorsement of it, or a guarantee that it is genuine, accurate, current or suitable for you. A position may be filled or withdrawn before its advert is removed.

Being asked to pay for work
South African law generally does not allow a work seeker to be charged a fee for employment services, such as being placed in a job. Be careful if anyone you deal with through Recruit 360 Jobs asks you to pay in order to get or keep an offer of work, and let us know.
Your sign-in and your details
Give accurate information, and keep your contact details up to date. Apply and register as yourself, with your own CV: the service does not provide for applying in another person's name or on their behalf. Keep your sign-in codes and the email account they are sent to under your own control, and tell us promptly if you think someone else has used them.
Your CV and other content
You keep your rights in your CV and in anything else you submit. You give us a non-exclusive permission, free of charge, to host, copy, read, format and transmit that material as needed to provide the service, including sending it to the agency you choose and hosting it for that agency on its instructions, in line with the privacy notice and the law. We ask for no wider permission.
Send us material that you are entitled to send, including any information about other people, such as referees.
The Recruit 360 Jobs software, design, name and logos belong to us or to those who license them to us. These terms allow you to use the service for your own job search, and give you no other right in it.
Who receives your information
The agency you apply to or register with receives your profile, your CV and your contact details, and may pass them to its client, the employer, or to others under its own privacy terms. Our staff and service providers have access where that is needed to run, support and secure the service. An agency is not shown your profile through Recruit 360 Jobs unless you apply to or register with it.
If you created your profile on our own registration page rather than through an agency, the visibility setting on your profile applies instead; the privacy notice explains it.
A later change, such as withdrawing an application or closing your account, does not recall what an agency has already received or passed on. The privacy notice explains who can see your information, and how it is handled.
Acceptable use
Use Recruit 360 Jobs for your own job search. Do not give false or misleading information, pretend to be someone else, upload anything harmful or unlawful, try to reach accounts, records or systems that are not yours, scrape the service or collect adverts or other information from it in bulk, use automated tools in a way that burdens or bypasses it, or infringe anyone else's rights.
How we run the service
We may maintain, change, limit or withdraw features or the service, and apply limits on use. Where we reasonably suspect fraud, abuse, a security risk or a breach of these terms, or where the law requires it, we may remove content and suspend, restrict or close an account. An agency may change or close its own pages and adverts.
We do not promise that the service, or any feature, will be available without interruption or error, or that what you store here will be kept indefinitely. Keep your own copy of your CV.
Our responsibility to you
Please read this section carefully. It limits what we are liable for and the claims you can bring against us.
Recruit 360 Jobs is provided to job seekers free of charge, as it is and as it is available. We do not guarantee a reply, an interview, an offer, employment or any other outcome. As far as the law allows, we are not liable for:
Agencies and employers. What they do or fail to do, including their recruitment and employment decisions, how they deal with your application or registration, and what they do with information they have received.
Adverts. An advert that is inaccurate, misleading, fraudulent, out of date, withdrawn or unavailable.
Applications, alerts and messages. An application, registration, alert, email or other message that fails, is delayed or is not acted on.
Interruptions and third parties. An interruption or fault in the service, a loss of data, or the failure of a service provider, a network or an agency's website that the service relies on.
Automated tools. An error made by an automated tool, including in reading your CV, interpreting a search, or screening, matching or scoring an application.
Lost opportunities and indirect loss. The loss of a job, an interview, an offer or any other employment opportunity, loss of earnings or income, and any indirect or consequential loss.
This section does not limit our liability for loss caused by our gross negligence, our intentional misconduct or our fraud, and it does not take away any right, or limit any liability, that the law does not allow to be excluded or limited, including rights you may have under the Consumer Protection Act and the Protection of Personal Information Act.
Withdrawing, closing your account and deletion
These are separate steps, and the privacy notice explains what each removes and what is kept.
Withdrawing an application tells the agency that you are no longer a candidate for that position. It does not delete the agency's record of you.
Closing your account ends your sign-in with us and removes your profile and your CV from your account. You can close it in your account or by writing to us. It does not withdraw an application already sent.
An agency's records. The agency is responsible for its recruitment records about you, including those we host for it, and it decides on a request to delete them. You can make that request to the agency or, where your account offers it, through your account. We act on the agency's instructions. An agency or an employer may also hold copies outside our systems, which we do not control.
Our own processing. For your account and the other information we are responsible for, send your request to us at [email protected]. We may keep limited records where the law allows or requires it.
Changes to these terms
We may change these terms. A change applies from the date it takes effect, and not to anything that happened before it. We will give reasonable notice of a material change, on the service or by email, before it takes effect, and where your agreement is needed we will ask for it, for example when you next apply or register. If you do not accept a change, you may stop using the service and close your account. A change to these terms does not replace the privacy notice, or a consent that the law requires.
Law and disputes
South African law governs these terms, and the South African courts have jurisdiction. Please raise a complaint with us first, so that we can try to resolve it. These terms do not stop you from approaching a consumer protection authority, the Information Regulator or any other body or court that has jurisdiction.
